Welcome to Nature's Child Photography ("we," "us," or "our"). By accessing or using our website (the "Site") and our photography services, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully.

1. Services Provided
Nature's Child Photography provides professional photography services, including but not limited to high school seniors, lifestyle newborns, families, and portrait experiences. All services are subject to availability and must be booked in advance through our official channels.

2. Booking and Retainer
- A non-refundable retainer fee is required to secure your session date and time.
- Your session is not confirmed until the retainer is paid in full and a formal contract is signed.

3. Cancellations and Rescheduling
- Rescheduling: If you need to reschedule, please notify us at least 48 hours in advance. Your retainer may be transferred to a new date, subject to our availability.
- Cancellations: Cancellations made without intent to reschedule will result in the forfeiture of the retainer fee.
- Weather: For outdoor sessions, we reserve the right to reschedule due to inclement weather at no additional cost to you.

4. Payment Terms
- The session fee is due at the time of booking in order to reserve your date and is non-refundable unless otherwise stated in writing. Session fees do not include digital images, artwork, albums, or printed products unless specifically outlined in your selected collection or agreement.
- Portrait orders and collection purchases are placed after your image reveal and ordering appointment. Final images and products will not be delivered until full payment has been received.
- Wedding balances are due in full no later than two (2) weeks prior to the event date unless otherwise agreed upon in writing.
- We accept major credit cards, cash, and designated online payment methods.

5. Image Delivery and Archiving
- Reveal and ordering appointments are typically scheduled within approximately one to two weeks following your session, though timing may vary depending on scheduling, season, or multi-part/split sessions.
- For senior sessions completed in multiple parts, the reveal appointment may take place after all portions of the session have been photographed unless otherwise arranged.
- Retouching, digital preparation, album design, and product fulfillment begin only after payment has been completed in full.
- A complimentary web-sized sharing gallery is typically delivered within approximately two weeks after full payment and final order confirmation. Wedding galleries are typically delivered within six to eight weeks following the wedding date.
- Archiving: We retain raw and edited files for a period of 12 months following your session. After this period, we are not responsible for maintaining copies of your images. It is your responsibility to download and backup your delivered images.

6. Copyright and Usage
- Our Rights: Nature's Child Photography retains the copyright to all images created during the session. We reserve the right to use the images for promotional purposes, including our website, portfolio, social media, and marketing materials, unless a specific privacy agreement is established in writing prior to the session.
- Client Rights: Clients who purchase high-resolution digital images or digital image collections are granted a limited, personal, non-exclusive license to print and share those purchased images for personal use only.
- Complimentary web-sized sharing images are intended for personal online sharing and social media use only and are not licensed for printing.
- Images may not be altered, edited, filtered, screenshot, or modified in any way without written permission from Nature’s Child Photography.
- Commercial use, publication, resale, or distribution is prohibited unless expressly authorized in writing.

7. Liability
While we take every precaution to ensure the safety and quality of your images, Nature's Child Photography is not liable for issues beyond our control, including but not limited to equipment failure, data loss, or uncooperative subjects. In the unlikely event of a total failure, our liability is limited to a full refund of any monies paid.

8. Client Cooperation
The successful outcome of a session depends on the cooperation of the subjects. We are not responsible if individuals, including children, fail to cooperate, resulting in a lack of desired images. We will use our professional judgment to capture the best possible images under the circumstances.

9. SMS Communications & Marketing
By opting in to receive text messages from Nature's Child Photography, you agree to the following terms:
- Program Description: We send text messages to communicate regarding photography sessions, scheduling updates, design and viewing appointments, order status updates, and occasional promotional offers.
- Frequency: Message frequency varies depending on your interactions with us.
- Opt-Out (STOP): You can cancel the SMS service at any time. Just text "STOP" to our number (904-239-7995). After you send "STOP", we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.
- Support (HELP): If you experience issues with the messaging program, reply with the keyword "HELP" for assistance, or contact us directly at [email protected].
- Rates: Message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text or data plan, please contact your wireless provider.

10. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Jacksonville, FL.

11. Modifications
We reserve the right to update or modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site and our services constitutes your acceptance of the revised terms.
